The terms, plainly.
What you can expect from us, and what we ask of you. The Privacy Policy covers your data.
The agreement
These terms are an agreement between you and WhisprNotes, Inc. (“we”) for using the WhisprNotes apps for Mac and iPhone, whisprnotes.com and our other websites (together, “WhisprNotes”). By making an account or using WhisprNotes you accept them. Our Privacy Policy explains how we handle your data and is part of these terms.
If you use WhisprNotes for an organization, you accept these terms for it, and confirm you’re allowed to.
Your account
You need a WhisprNotes account to use the apps. You must be at least 13 (16 in the EU and UK). Give us an email address you control: we sign you in by emailing a one-time code, so whoever controls that address controls the account. Tell us at once if you think someone else has used it.
One account is for one person. You’re responsible for what happens in your account.
Plans and payment
Free costs nothing, needs no card and works on each device you sign in on, with everything kept on that device and no sync. Pro is a subscription, monthly or yearly, sold only on our website; it adds sync, backup and share links. The clinician pack is priced on its own, per clinician; it has no price yet, and we’ll put it on the pricing page before you could be charged for it. Pro’s prices are on the pricing page.
Pro and the clinician pack aren’t on sale yet. Once they are, a subscription renews at the end of each period until you cancel; you can cancel anytime on your account page, and you keep what you paid for until the period ends. We’ll tell you before a price change applies to you, and you can cancel before it does. Refunds follow the law where you live.
If Pro ends, your notes stay on your devices; sync stops and your share links pause until you come back.
Your content
What you record, write and sync is yours. We don’t claim ownership of it.
To run WhisprNotes you give us permission to store, copy, sync, back up and display your synced content and your shared notes, only as needed to provide the service to you. If “Help improve WhisprNotes” is on, you also let us use your synced text, after it’s anonymized as the Privacy Policy describes, to improve WhisprNotes; you can turn that off anytime. Content that stays on your devices never reaches us.
Make sure you have the right to what you put in WhisprNotes.
Recording people
WhisprNotes can record meetings and conversations. Many places require that everyone being recorded is told, or agrees. You’re responsible for following the recording and consent laws that apply to you and to the people you record. Let people know you’re taking notes.
Clinical use
The clinician pack helps a clinician draft notes; it isn’t a medical device and doesn’t make clinical decisions. Every draft, code suggestion and summary must be reviewed, corrected and signed off by the clinician, who stays responsible for the record and for the care given.
Clinical notes and their recordings stay on the clinician’s Mac and never sync. Unless we sign a business associate agreement with you, don’t sync, share or otherwise send protected health information to our servers, and make sure your use meets HIPAA and the other rules that apply to your practice.
AI output
Transcripts, cleanup, meeting notes, answers and playbook drafts are made by models and can be wrong or incomplete. Check them before you rely on them or send them anywhere. Playbooks never send anything without your approval.
Using WhisprNotes fairly
Don’t use WhisprNotes to break the law or anyone’s rights; to record people unlawfully; to send spam or malware; to get around plan limits or other people’s access controls; to overload, probe or attack our servers; or to copy or resell the service. You may not reverse engineer our servers or websites, except where the law allows it.
Other apps you connect (for example through the local MCP server, Shortcuts or a playbook) are governed by their own terms.
The apps
We give you a personal, non-transferable license to use the WhisprNotes apps on devices you own or control, under these terms. The apps may update themselves. Features marked beta may change or be withdrawn. The open-source components inside the apps are under their own licenses, listed in the apps.
Ending
You can stop using WhisprNotes and delete your account anytime, on your account page or by writing to us. We may suspend or close an account that breaks these terms or puts others at risk; where we can, we’ll tell you first and give you time to take your synced content out. Sections that by their nature should last (your content, disclaimers, limits of liability) survive.
Disclaimers and limits
We work hard to keep WhisprNotes reliable, but we provide it “as is” and “as available”, without warranties of any kind, to the extent the law allows. Keep your own copies of what matters: on Free, notes are kept only on the device they were made on.
To the extent the law allows, we aren’t liable for indirect, incidental, special or consequential damages, or for lost data or profits, and our total liability for any claim about WhisprNotes is limited to what you paid us in the 12 months before it (or $50 if that’s more). Nothing here limits liability that can’t be limited by law, or your rights as a consumer where you live.
Changes and contact
We may update these terms. For a change that matters we’ll tell you in the apps or by email before it takes effect; if you keep using WhisprNotes after that, the new terms apply. Nothing in these terms takes away the protection of the consumer laws where you live.
